Programme Highlights

The resolution of disputes by means of Alternative Dispute Resolution (ADR) such as mediation and arbitration is seen to be performing satisfactorily in the construction industry. In order to explore ways of improving the cost-effectiveness of our system of civil procedure and of reducing complexity and delays in litigation, the Chief Justice appointed a Working Party in February 2000 to review the civil rules and procedures of High Court. According to the recommendations made in Section 29 of the Final Report of the Working Party on Civil Justice Reform, court-related mediation or other forms of ADR should be promoted. Therefore it is anticipated that the whole community in Hong Kong will seek to avoid litigation by using mediation or other forms of ADR in the near future.

Mr. Kwan is a Teaching Fellow and Associate Programme Leader of the Master of Arts in Arbitration and Dispute Resolution Programme in the School of Law, City University of Hong Kong.
